Term of Service

e-Tech Mandiri (e-Tech) provides services to clients all around the world. e-Tech has the responsibility to protect each client and provide them with the best services available. The following guidelines were designed to insure these services. The terms of service are applicable to all e-Tech clients.

Content:
All services provided by e-Tech Mandiri may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any Federal, State, City or local law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, unlicensed software or files, or material protected by trade secret and other statue. The subscriber agrees to indemnify and hold harmless e-Tech from any claims resulting from the use of the service which damages the subscriber or any other party. Regardless of the place of signing this agreement, the client agrees that for purposes of venue this contract was entered into in Bantul, Yogyakarta, Indonesia, and any dispute will be litigated or arbitrated in Bantul, Yogyakarta, Indonesia.

e-Tech will be the sole arbiter as to what constitutes a violation of this provision.

Unlimited Traffic/Hits & Server Resource Usage:
e-Tech is pleased to offer our clients unlimited traffic/hits, and server usage. Unlimited Traffic/Hits refers to the number of visitors to your website, NOT the amount of bandwidth/data transfer. Your account is still limited to the alotted bandwidth/data transfer included with your selected package. To maintain the integrity of our service the following traffic/usage limitations apply.

  • Sites with banners, graphics or cgi's running from their domain being used on other domains.
  • Sites with immense graphic archives or galleries.
  • Sites offering immense download archives, such as .zip, .tar, .rar and .GZ.
  • Sites running large chat room gatherings.
  • Sites using more than 20% of system resources

If you do not qualify for unlimited traffic/hits, your account may be required to be upgraded, or, e-Tech may move your site to a different server, to reduce the load on the server you are currently residing... e-Tech will be the sole arbiter as to what constitutes a violation of usage limitations. Bandwidth/data transfer will go unmonitored until you reach your account limit, then normal over-usage data transfer costs will apply. At any time e-Tech may move your site to a different server, to reduce the load on the server you are currently residing...

Chat Rooms:
e-Tech does allow clients to install their own chat rooms. However, these tend to be large system hogs and may fall into the usage limitations clause. We do provide a html based cgi chatroom that runs without hindering the performance of the machine for others. You are free to run your own chat script, as long as it does not hinder server performance.

Background Processes/Programs
e-Tech may allow programs to run continually in the background, these are considered on a one to one basis and a extra charge may be incured based on system resources used and operational maintenance needed.

IRC:
e-Tech currently does not allow IRC or IRC bots to be operated on our servers.

Multiple Connections:
Multiple telnet and ftp sessions are allowed, on a single hosting account.

Idle Timeouts:
e-Tech may disconnect any idle connection to the network.
Average timeouts are:
FTP - 300 seconds
Telnet - 2 hours

Commercial Advertising - Email:
Spamming, or the sending of unsolicited email, from a e-Tech server or using an email address that is maintained on a e-Tech machine is STRICTLY prohibited. For general reference, we consider spam any email that is sent to more than 10 people at a time that did not ask for it to be sent to them.
e-Tech will be the sole arbiter as to what constitutes a violation of this provision. Opt-In email is acceptiable, as long as Opt-Out/Removal request are fully honored. Please make an effort to limit outgoing mail on your account to no more than 1000 pieces per hour. Large mailings are preferred to be sent from the hours of 12AM - 8AM GMT

Server Abuse:
Any attempts to undermine or cause harm to an e-Tech server or customer of e-Tech is strictly prohibited. e-Tech will pursue legal action to the fullest extent for all abuse of the e-Tech Network.

Suspension/De-Activation:
If any terms or conditions are failed to be followed it will result in grounds for account suspension or de-activation. e-Tech reserves the right to remove any account without prior notice. If e-Tech deactivates your account(s) for violating policy, you will forfeit your rights to a refund...and none will be given. No refunds for advance payments, on de-activated accounts. Normal policy is a warning first, and account de-activation the second offense. Serious offenses may cause immediate de-activation.

Payment Due Date Policy:
A billing notice is sent to you 5 days prior to your payment due date. Please settle your account/s on or before your due date. There is a 24 hour grace period after payment due date for you to settle your account/s. After the 24 hour grace period has elapsed and no payment has been received, your account will be suspended. A $3 reactivation fees will be charged for suspended account due to late payment.

Cancellation Policy:
For Shared and Reseller Hosting, no refund will be given to the Client should the Client decide to terminate the service five (5) days after payment. Also, there is no refund for domain name registration after payment has been made. We also require one week advance notice for account cancellations. For any cancellation notice we received less than one week prior to your payment due date, we will still charge your credit card. For Dedicated Servers, no refund will be given once payment has been made.

Privacy Policy:
e-Tech Mandiri respects the privacy of every individual who visits our Web sites, responds to our interactive advertisements or sends us e-mail. This Privacy Statement outlines the information e-Tech will collect and how we will use that information. This Statement will also instruct you on what to do if you do not want your personal information collected or shared when you visit e-Tech Web sites, respond to our Web-based advertisements or send us email.

If you do not want your personally-identifiable information collected, please do not submit it to us. If you have already submitted this information and would like for us to remove it from our records, please contact us. We will use reasonable efforts to delete your information from our existing files.
When you do provide us with personally-identifiable information, we may use that information in the following ways, unless stated otherwise:

  • we may store and process that information to better understand all customer needs and how we can improve our products and services for all customers
  • we may use that information to contact you with new promotions and announcements if you have previously provided your permission and if the promotions and announcements are in your interest
  • we may contact you if we have questions about your account

e-Tech will not sell personally-identifiable information to third parties, unless stated at the time of collection. We may share information with business partners. We are committed to giving you the choice whether or not we use your information for marketing purposes or share information with business partners.

Support Restrictions:
e-Tech does not provide support for 3rd party scripts including but not limited to all scripts listed in Fantastico, RVSiteBuilder, ClientExec and any other script unless explicitly stated. If you open a ticket requesting support for a 3rd party script, your ticket will be reprioritized as low priority and may be closed without an answer. It is your responsibility to ensure your scripts are compatible with our server environment.
The offer of any particular service does not constitute an obligation on e-Tech part to tutor the necessary skills to utilize that service, only to provide system-specific information.

Indemnification
CUSTOMER AGREES THAT IT SHALL DEFEND, INDEMNIFY, SAVE AND HOLD e-Tech Mandiri HARMLESS FROM ANY AND ALL DEMANDS, LIABILITIES, LOSSES, COSTS AND CLAIMS, INCLUDING REASONABLE ATTORNEY'S FEES ASSERTED AGAINST e-Tech Mandiri, ITS AGENTS, ITS CUSTOMERS, OFFICERS AND EMPLOYEES, THAT MAY ARISE OR RESULT FROM ANY SERVICE PROVIDED OR PERFORMED OR AGREED TO BE PERFORMED OR ANY PRODUCT SOLD BY CUSTOMER, IT'S AGENTS, EMPLOYEES OR ASSIGNS. CUSTOMER AGREES TO DEFEND, INDEMNIFY AND HOLD HARMLESS e-Tech Mandiri AGAINST LIABILITIES ARISING OUT OF; (1) ANY INJURY TO PERSON OR PROPERTY CAUSED BY ANY PRODUCTS SOLD OR OTHERWISE DISTRIBUTED IN CONNECTION WITH e-Tech Mandiri's SERVER; (2) ANY MATERIAL SUPPLIED BY CUSTOMER INFRINGING OR ALLEGEDLY INFRINGING ON THE PROPRIETARY RIGHTS OF A THIRD PARTY; ( 3) COPYRIGHT INFRINGEMENT AND (4) ANY DEFECTIVE PRODUCTS SOLD TO CUSTOMER FROM e-Tech Mandiri SERVER.

e-Tech Mandiri WILL NOT BE RESPONSIBLE FOR ANY DAMAGES YOUR BUSINESS MAY SUFFER. e-Tech Mandiri MAKES NO WARRANTIES OF ANY KIND, EXPRESSED OR IMPLIED FOR SERVICES WE PROVIDE. e-Tech Mandiri DISCLAIMS ANY WARRANTY OR MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. THIS INCLUDES LOSS OF DATA RESULTING FROM DELAYS, NON-DELIVERIES, WRONG DELIVERY, AND ANY AND ALL SERVICE INTERRUPTIONS CAUSED BY e-Tech Mandiri AND ITS EMPLOYEES. e-Tech Mandiri RESERVES THE RIGHT TO REVISE ITS POLICIES AT ANY TIME.
e-Tech Mandiri RESERVES THE RIGHT TO CANCEL/SUSPEND/TERMINATE YOUR ACCOUNT AT ITS OWN DISCRETION WITH OR WITHOUT REASON IF IT FEELS THE ACCOUNT WILL CAUSE DAMAGE TO THE ORGANISATION OR ANY OTHER REASON. e-Tech Mandiri RESERVES THE RIGHT TO ALTER THE SERVICES PROVIDED AT ANY TIME WITH OR WITHOUT NOTICE.
ALL SUB-NETWORKS, RESELLERS AND DEDICATED SERVERS OF InnoHosting MUST ADHERE TO THE MENTIONED HERE POLICIES.
FAILURE TO FOLLOW ANY TERM OR CONDITION WILL BE GROUNDS FOR IMMEDIATE ACCOUNT DEACTIVATION.
